A BILL to amend article nine, chapter sixty-four of the code of
West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
nineteen, relating to authorizing the health care authority to
promulgate a legislative rule relating to benchmarking and
discount contracts.
Be it enacted by the Legislature of West Virginia:
That article nine, chapter sixty-four of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
nineteen, to read as follows:
ARTICLE 9. AUTHORIZATION FOR MISCELLANEOUS AGENCIES AND BOARDS TO
PROMULGATE LEGISLATIVE RULES.
§64-9-19. Health care authority.







The legislative rule filed in the state register on the
twenty-sixth day of July, two thousand two, under the authority of
section eight, article two-b, chapter sixteen, of this code,
modified by the health care authority to meet the objections of the
legislative rule-making review committee and refiled in the state
register on the second day of December, two thousand two, relating
to the health care authority (benchmarking and discount contracts,
65 CSR 26), is authorized.







NOTE: The purpose of this bill is to authorize the Health Care
Authority to promulgate a legislative rule relating to Benchmarking
and Discount Contracts.
